Below is a true story of events leading upto a innocent law obidding citizen been found guilty of a crime he did not commit.

A story of a working man going about his dutys who finds himself accused of damaging a parked vehicle and failing to stop or report the incident. Some may feel justice was served and that i was guilty but i know the truth and can go to my grave with a clear concience those involved who have lied and failed in there duty know they have lied and failed. 

Wensday 30th August 2006 Alleged Accident Date

At around 2pm – 2.10pm that afternoon i had been delivering to the Art shop at the top of Newton Rd Mumbles. On finishing this delivery i got back into my vehicle which was parked on Newton Rd. I had one more delivery to make in the Mumbles area

I put the next delivery post code and house number into my sat nav. And waited for it to locate the address.I drove a little way down Newton Rd “heading down hill towards the mini roundabout”.After a short distance i turned left “which i now know to be Stanley Rd” i drove along here to the Queens Rd intersection i carried straight onto Kings Rd heading up hill i passed a van which was unloading what i believe to be furniture on my left.

At about 200 – 300 yards up Kings Rd vehicles was parked on my left and right, the road was narrowing at this point. I realised that i was not going to be able to carry on any further along Kings Rd.At this point i started to reverse back. As i neared the van one of the gentlemen came along side and asked “would i like him to watch my back” i replied something like cheers mate.

He guided me back so i was able to reverse into Queens Rd i then turned left back onto Stanley Rd and pulled up on the left so i could phone my depot.I spoke to Kevin in the office and told him i was unable to get to my next delivery as the road was narrow he gave me a referrence no. which related to the delivery being delivered the next day using the small van as was driving a 7.5 tonne lorry.

I drove to the end of Stanley Rd and turned Left back onto Newton Rd heading back to Nova leisure 665 Gower Road, Upper Killay, Swansea, This was my last call each day, here i would pick up parcels to be taken back to the depot at Ammonford.

I arrived at Nova leisure at around 3pm – 3.05pm. Whilst waiting to be loaded, i was doing my paperwork in the cab of my vehicle when the cab phone rang. This would be about 3.15 – 3.20pm.

On answering the phone i was informed by my manager Wyn Robinson that i had been involved in an accident in Mumbles.

I told Wyn that i had not been involved in any accident that day.

He asked me to check the vehicle for damage which i did and told him that there was none to be found.

On arrival back at the depot at around 4.15pm Wyn was waiting for me, we both inspected my vehicle for any damage that should have been present after a collision. The whole of the outside of the vehicle was inspected and no damage could be found, dents, scatches, paint damage, broken lights or indicators.As there was no damage to be found on my vehicle i was not required to fill in any accident report sheets. And was told by Wyn that he was waiting for the owner to call him back.

Nothing more was heard of this until the end of November 2006 some 3 months later when i was informed by my partner that i was wanted by the police in connection with a road traffic accident. We live only 2 doors down from the police station in kidwelly and i can not believe that a officer could not have walked some 50 feet to knock on the door.

I contacted the police straight away and went along to give a statement.
Again i heard nothing until March 10th or 11th 2007 again some 4 months later, this was a court summons stating i was been charged with 3 traffic offences and giving me a court date to attend.

I attended court on the required date and time and was unable to defend the case as i had received nothing from the cps (crown prosecution service)or policei asked for all relevant information regarding the case and was told to reapper in court in 2 weeks where i would be given all witness and police statements, i was also placed on bail ?

Now into april 2007 and second appearance in court where i was handed all statements, again case was adjourned for 2 weeks

on reading the statements noticed many discrepencies involving the father and son statements, i.e speed of vehicle, desciption of driver, where the driver was, the father states he spoke to the driver but does not mention any accent ? Also they both state they was no more than 3 feet away from the driver yet neither of them mention tattoes ? Neither do they get hair colour, height, build, age correct ? Yet they have spoken to the driver only 3 feet from them ?

They both claim the driver was doing something at the front of the vehicle like trying to fix something. You would have to be built like man mountain to be able to straighten anything on a 7.5 tonne lorry.

Also father and son both claim in the first few lines to be good friends with the owner of the vehicle ?????????

The owners wife claims in the first line she hears a loud bang and her first thoughts are oh my god i hope its not my husbands car ??????????????????

i hear bangs and loud noises everyday and night, both mine and my partners cars are parked outside, i certainly dont jump up thinking everytime, oh my god i hope its not our cars ??????????

the police report sheet has the owner of the vehicle reporting the incident at 2 differnet times the 1st being some 27 hrs later and on the second sheet not reporting the incident until the friday morning at 10am some 44hrs later ????????????

why so long to report ????????????????

the police officer never inspected my vehicle or had anyone else from the polcie inspected the vehicle ??????????????

the officers response in court to this was he had passed on the info

as required to do so as this was his stations policy ??????

is he not responsible to investiagte the incident fully ????????

or is it as he stated in court he decides what cases he will prosecute ?????????????????

Nothing the witnesses have written or spoken in court matches

statements say one thing, and both appearances in court by the witnesses do not match up storys have changed.

I was found guilty of a crime a i did not commit and recieved 5 penalty points and a £650 fine plus costs.

My story has never changed in any way from me telling my manager on arriving back at the depot or telling my wife when i got in that evening, My story has remain the same throughout both in the Magistrats and Crown Courts. Why because its the Truth 

Yet the witnesses and owners of the vehicle have changed from there statements given to the police and from what was said by them in both the magistrats and crown courts, my barrister had to pull them up on many occassions during the course of there time giving evidence.

Basically im expected to prove i was not in Park Street, i drove the vehicle on my own how can any lone driver prove he wasn't there ?????????????

The evidence from my vehicle should tell the story, But the Judge in all his wisdom stated that due to modern technology in the making of vehicles it is possible to cause so much damage to another vehicle yet not incurr any to your own ?? HOW

The witnesses stated in court that the front panel was peeled back surely it would be expected to leave a scratch or more to my vehicle ?????

To me a Law obidding citizen who has never committed any crime and was brought up by my parents to respect the law and have faith in the law i feel i have been sadly let down by both the police and courts.

How can anyone have respect in a system which fails to do its duty by investigating a crime fully and getting all relevent facts in the first place correct then procedding to court where lie's are openly told and accepted as truth.

If the police had done there job correctly and inspected my vehicle for damage surely common sense would dictate that alot of time and grief could have been saved !!!!!!!

I now have no respect or faith in the law of this country a system sadly out of tune with a nation, from all ive seen of this system the police are over paid parking meter and speed camera collection agents who are incapable of performing there duties correctly 

If you or i was to perform as badly in our jobs/carrers we would be sacked ??????
