If ANYONE - Republican or Democrat violated any law - they should be prosecuted fairly and without prejudice. If they are GUILTY AS CHARGED - either Republican or Democrat - they should (a) be removed from office (if currently serving) and (b) be incarcerated as the criminal offense merits.
