A SHORT NOTE
S. Jasbir Singh gave an affidavit to the Nanavati Commission after nearly twenty-two years. In the affidavit, he stated two things about Mr. Jagdish Tytler:
(a) After Mrs. Gandhi’s assassination, i.e: on the 3rd November, 1984 at 11.00 p.m. he saw Mr. Jagdish Tytler near the gate of the T.B. Hospital, rebuking a group of people saying that his “instructions had not been faithfully carried out. There had been only a nominal killing in the constituency compared to other places, as I had promised.”
(b) He also states that he stayed in the house of S. Sucha Singh, and that he went and told him, in detail, what he saw and heard.
The CBI investigated the above affidavit and gave a report to the Judge of the Hon. Court on 04/10/2007 (We have copy of the Order)
SEQUENCE OF THE CASE
On 04/10/07, Mr. H.S.Phulka, Mr. H.J.S. Ahluwalia and Mr. Kumar Saurabh from the Delhi Sikh Gurudwara Managing Committee submitted an application to supply the Charge Sheet given by the CBI u/s 173 IPC. The Hon. Court called Inspector Ranbir Singh, S.H.O. and he also stated that he was present on the spot at the time of the alleged incident and that he did not see Shri Jagdish Tytler and others near the spot instigating the mob to commit the alleged offence.
On 29/11/2007, Mr. H.S. Phulka, Advocate promised the Court to submit the address of S. Jasbir Singh who had submitted his affidavit before the Justice Nanavati Commission on 31/08/2000.
The Affidavit of Sucha Singh whose name had appeared in the affidavit of Jasbir Singh where he (Sucha Singh) denied knowing Jasbir Singh.
On 6/12/2007, a Mr. Nav Kiran Singh appeared in the Court as Counsel of Jasbir Singh and filed an application against the “clean chit” given to Mr. Jagdish Tytler by the CBI in the 1984 Riots. The Counsel for Shri Jasbir Singh filed a protest petition before the Hon. Court, stating that his client was an informant - i.e: not a witness.
Court Order of 6/12/2007 regarding Jasbir Singh’s address approved by the Court and filed against the “clean chit”given by the CBI to Mr. Jagdish Tytler in the 1984 Riots.
On 18/12/2007 the Court instructed the CBI to further investigate the Jasbir Singh allegation and submit a report by 16/1/2008.
The CBI made their best efforts to contact Jasbir Singh and his family members to find out his whereabouts, nor could they find out anything against Shri Jagdish Tytler.
Both the statements are found false and fabricated. Delhi was under curfew with “shoot at sight” orders. Shri Jasbir Singh had stated in his affidavit that he had stayed in the home of Shri S. Sucha Singh. Shri S. Sucha Singh has also submitted his affidavit in which he states that he has never even seen S.Jasbir Singh and that he had not stayed at his home on 03/11/1984.
Viewed in the perspectives of Shri Sucha Singh’s affidavit and statement combined with the curfew on that day, the statement that Shri Jasbir Singh had heard Shri Jagdish Tytler instigating the people collected at the gate of the T.B. Hospital to kill more sikhs, fails. No incident of arson, burning or killings was reported in any area including Outram Lines and Kingsway Camp or Delhi.
After seeing the newspapers and and on a wrong information by a T.V. Channel, Shri S. Sucha Singh released his statement to the electronic and print media.
S. Jasbir Singh has been declared a Proclaimed Offender (PO) and there is an open warrant of arrest against him by the Order of the Additional Sessions Judge, Shri Rajiv Mehra on 20/01/2004 and that is why he is not willing to come to India.
