So, to make my whole week a whole lot better…I just found out that, not only do I need to find a new apartment, and that my grandmother is practically dying, my parents are being sued. We’re not sure why though. My parents moved out of the country a long time ago, and the mail that we normally get was forwarded over to their friends. Well, those same friends called my parents yesterday and told them that they were being sued and that they had to appear in court January 3, 2008 (great things happen on Christmas day). My parents called me, not knowing what to do and were wondering if I could fax them the letter, scan it or do something…since their “friend” is somewhat technology illiterate. So now, I’m waiting for the lady to mail me the letter.
So many questions run through my mind though…why would we be sued years after leaving the country? There is no way my parents can make it to the USA in time for the court appearance, would it be okay for them to call and reschedule or something? What would happen if they don’t call and don’t appear? Would they be stopped at the airport when (and if) they come to visit me? Would I be able to appear in court for them? If I can, then would any collection agency or state law permit that the people suing my parents follow me and my address here in California? I just need a little bit of help…please!

I would see just what it is that they are being sued for. If it is a collection agency, most likely all that would happen (and this is from past experience of mine) is that if they do not appear there will be a judgment posted against them to retrieve the money....i do not think they could sue you because you are old enough to be on your own and not living with them. Just remember I AM NOT A LAWYER AND THIS IS ONLY BY PERSONAL EXPERIENCE. If they are being sued by an individual then contact a lawyer.

I would strongly recommend that you contact a lawywer for guidance in this matter. I agree with friends101 when he stated that what happens when you don't appear in court when ordered is that the court will more than likely render a judgment in your absence and if it is money involved, you will more than likely be ordered to pay. If they are not able to attend this hearing and they have a good reason, why not faxed this request to the court stating why an extension is necessary for it is always better to have black and white documentation when dealing with the law. You should call the court of which this case is scheduled and ask for their fax number and make sure that you keep documentation of this request and communication. If you are not able to afford an attorney, seek out the various legal assistance agencies that are in most states for guidance. The law can be so complicated at times and it is in your best interest to seek legal counsel if you can. God bless you and Godspeed.
