Judge rules on some requests at Casey Anthony hear
2:02 PM EDT, October 10, 2008

Judge Stan Strickland will not rule today on the remaining motions filed by defense attorney Jose Baez that were argued this morning, including a request to seal Anthony's weekly home confinement schedule.

Strickland also did not rule on: - A motion for allowing Anthony to travel to places of interest - A motion to preserve forensic evidence and for court to consider additional testing Neither Casey Anthony nor her family attended the hearing. Several local and federal detectives were in the courtroom, but none were called to testify.

Speaking in regard to his request to have Anthony's schedule sealed, Baez said his main issue is security and Anthony's safety. Baez said there may be people who want to hurt Anthony.

But county attorney Tamara Gappen argued that Anthony's weekly schedule is public record, and the county has to follow the law. She said Baez has shown no legal exception to the public records law.

Sentinel attorney Rachel Fugate also argued against Baez's motion. "The protestors are not going to go away. The media is not going to stop covering this case," she said.

In a separate motion, Baez requested Anthony be allowed to travel with him and the bondsman.

A representative from the company who posted a portion of Anthony's $500,000-plus bond testified that he does not think she is a flight risk. He told the judge the travel would be local and Anthony would not go out of state.

Baez told Strickland he wants a specific period of time where he can travel with Anthony to certain places of interest in regards to the case. Baez said Anthony needs to be able to contribute to her defense.

The county opposed that motion. Gappen said it was vague. She said "key points of interest" are unknown locations and home confinement staff would have no idea where Anthony is and it would be a burden for county staff to follow her.

During the hearing that lasted several hours today in a packed courtroom, Strickland ruled on several of the motions filed by the defense, including:

- Baez's request for access to Anthony's vehicle, which is being held by the Orange County Sheriff's Office. A prosecutor argued the car is not going to be used in the child neglect case. Baez argued the defense should have "equal access" to the car. He said there may be something in the vehicle that could help the defense. "We deserve a search for the truth," Baez said. Strickland granted Baez's request.

- Baez's request for information on the tips that law enforcement has received regarding Caylee's whereabouts. Strickland said Baez can have access to the information so long as the tip has already been investigated by detectives.

After the hearing, where many of his motions were granted, Baez gave a brief statement:

"Obviously we are happy," he said, adding that the motions are important for the search of the truth and justice.

"What you are getting right now is rumor and conjecture," Baez said. "I think its about time we get down to the truth and find out which one of these reports is credible and which one is not."

Sheriff's Capt. Angelo Nieves spoke briefly after the hearing and said that the sheriff's office will comply with the rulings of the court and will turn over documentation that were ordered.

"One of the things we'd like to know is where Caylee is. That's what our main goal has been since the beginning of this case," Nieves said. "The truth that we want is where is Caylee."
