 PROBATE CONCERNS
This will only be significant to a few but if it can be helpful to just one, my job is complete.  PLEASE!!!! to those of you in second or other marriages - PLEASE!!!! do not allow a family member to be the executor/executrix of your estate.  My late husband of 20 years made his daughter his executrix and I am so suffering.  He died in 8/05.  His will provided for me to have my car I drove and the house that we lived in.  Now - the car - his daughter would not turn over the car for over a year.  My attorney and I even went so far as to give her the jewelry of her father's I could find in turn she would turn over the car to me and that was not good enough for her - she stole the jewelry right out of my lawyers office.  AND still she did not turn over the car.  It took me six more months and several calls on my own to get the car in my name.  As to the house - she won't open probate in South Carolina due to the fact that there is no money in the estate (that's a lie - there is money there that actually belongs to me that they won't turn over).  Because when i took out the loan to buy the house - i put my husband's name on the house so that if something should happen to me he would have a place to live - I can't even sell it because there is not a clear title.  Why don't i open probate here?  because i don't have the money to do so. My husband and his brother and sister owned a corporation that owns strip malls on long island and my husband owned roughly 25 - 30 percent.  he signed a paper with the corporation that his stock would be bought back within 190 days of the date of his death and here it is ??? and still there is no resolve.  His daughter's attorney has even gone so far as to state that she is reluctant to pursue the matter because she doesnt want to upset her uncle.  meanwhile..... while my husband was alive i was receiving the monthly check from the corporation but the minute he died it stopped - at least it stopped coming to me.  his one daughter has lived rent free in the uncles rental homes for that past 6 years at least.  the other daughter has a husband who has a very good job and is making a good salary.  there is reason to belive that my husbands "salary" has been split between the two girls all this time.  i went so far as to have my attorney in florida take the estate attorney to court and request an administrator at litem be appointed to move the case along and we are still bogged down.  the judge gave the estate attorney 30 days with which to subpoena the records needed from the estate to try to place a value on the stock and it is now almost 45 days and still no response as to whether or not she even did what she was supposed to do.  to those of you who have never had to deal with an estate problem, you have no idea how upsetting this has been from day one.  here i am working to save something and my monthly salary is not enough to even cary my bills - i racked up my credit cards trying to keep my head above water as i just believed with my everything breath that his daughter would do what was right and that she would do her job that her father gave her in his will and so far i have been so wrong.  the bank is getting ready to foreclose on my house - and i will loose everything that my husband and i purchased together.  for those of you who think im young and immature - im 55 years old.  i have never been  in this kind of situation before and am finding it very hard to get thru each and every day.  the horror story of this case just goes on and on and on.  PLEASE if anyone reads this and it hits a note with them, please sit down and discuss with your spouse or significant other about to avoid these kind of problems.  i will be very happy to answer any questions and try to help anyone with some suggestions about how to handle this kind of situation but first and foremost - let me say - GO SEE A LAWYER AND NOT ONE THAT THE FAMILY USES.  you need to get info from an uninterested party.  and for god's sake, tell the attorney about any family conflict.  in my case, my husband believed in his family first and foremost and his wife was last in his world.  and for those of you who think im >>>>>> let me just tell you i went thru one heart attack with my husband, one open heart surgery - where the doctor on the case told the nursing staff that they were to do and give me whatever i asked for when it came to my husbands care.  he also had diabetes for 8 years and was on 15 pills a day that he relied on me to make sure he had the right ones and i was also responsible for testing his bs every day and giving him his insulin shots - even thou when i first saw a needle i passed out.  it took almost a solid week of holding the needle before i could even stick him the first time and at that i was shaking.  what did he die from?  a brain hemmorage.  it was totally unexpected and very quick.  as a matter of fact i put him on life support so his daughters and brother could come to south carolina from fla to see him and they arrived on wednesday and he died on friday.  they left on saturday to go back to fla and proceeded to take his car back with them.  and then they argued that i had not decided what car i wanted to keep.  i say they left me no choice on what car to keep.  there are so many more incidents that have happened along the way and i truly want to reach just one person to try to get them to understand just how devasting this can be to a spouse.  so please please please recheck your wills, please provide for your spouse properly.  as much as i hate this and dont understand why his kids cant just settle the estate and let me get on with my life. i just want to keep my house and the few items in it that we have, but that is not possible and i have finally come to terms with it
