| Should I keep my will or get living trust?
I have a last will and testament in case I die. I want my children to inherent all my property, money and goods. I asked my lawyer to prepare a living trust document and he said, "You don't need that." I called him months later and left a message with his secretary with the same request and he did not returned my call. I was confused why would he not draw this' living trust document' for me.'
All my bills were paid immediately when he sent them. So, I did not owe him any money. Then I heard on TV on the Susan Ortman show that lawyers do not like to draw up living trust to replace or instead of wills because they cannot be contested in a court of law. A last will and testament can be contested and bring a lot of money.
Later I found out that it is rare, but a living trust can also be contested if the stakes are high. Now, I have to go and search for a lawyer that is willing to draw this living trust document for me in order to protect my children from their father's avarice. Even though we are divorced and the house is mine and so is all property, he is very crafty and with some crooked lawyer my children can be put in danger of loosing their inheritance.

Find an attorney who specialized in Estate Planning. That would be your best bet, and make sure you tell them exactly who you want to prevent from getting anything.
