First. Your example of Burden of Proof is absurd. Have you ever been to court? Have you had any..even a semister of pre-law? Primia Facia (or first evidence) does not require initial discovery. It can merely be an opinion or a testimony of a witness. The validity of the evidence is brought out as the case progresses.  The burden of proof then shifts to the defendant as he establishes an Affirmative defense or in this case an alibi (an 18th century defense...meaning another place).
