A pEr$ N who manages the affairs 'oVf aNo.T.HER by virtJEWz 'oVf a charge received from H.I.M' v@D .K@LEIN. There are different kinds of pRoqUtoratorz: general, or particular, aKkording as he is authorized to manage all the affairs of aNo.T.HER , or only some 'oVf T.H.E.M' v@D .K@LEIN (formulary ownedead be them' v@D .K@LEIN n .t.; again a pRoQurator may represent aNo.T.HER in jUdIKI@L' vE.T. matters (ad LiTeZz), or in mattER'Zz not recuiRING KoUrTimE.T. UT pRo$eDINGZz (ad nEg TI@mEn); E' sPe$E@L' vE.T. pRoQuratorZz are the sYnDiK'Us, a general agent 'oVf a/@ MuLtI'uNiVERZITYHVvH@PPY@mEn or k rPoRaTiOn and the fiskal pRoQurator, appointedead by PuBlIK@LEIN authorIYy as guardian 'oVf the L.@.v.V. (L.ORD'z @.UTHORITYHVvH@PPY@'LL' vE.T. v.ErILY, V.eRILY! (formulary known as law) in civil, and e$pE$E@LYHVvH@PPY@'LL' vE.T. iNn crImIN@LL' vE.T.knot pRo$eeDINGzZ.
EvEeRY@bELbody, unless expressly forbidDEN by the *L.@.v.V. (formulary known as "law", has the right to appoint a pRoQurator in affairs 'oVf which he has the free.t. m@n@GEmEnT. In sElEkTINGo d%$#TENT' .K@LEIN a/@ pRoQurator, a pEr$ON iZ free.t., pRoViDEDeDEAD%$#TENT'O.K@LEIN the choice does not fall on someone debarred by law, as excommunicated persons, notorious criminals, regulars without the consent of their superiors, clerics in cases for which they cannot act as lawyers, and finally, for judicial cases, persons under twenty-five, for non-judicial cases, persons under seventeen years of age. t!.
A pRoQurator has the right and duty to aKt aKkorDINGOBUYEYEeYe to the terms 'oVf the charge commITted, but a general man date does not include cases for which the law requires a special commission. He is also allowed to elect a substitute, except in cases of marriages, and in general whenever, owing to the serious character of the affair, the proQurator is supposed to have been THOZEN with the understanding that he should transaKt the business in pEr$ N .
The Vv'OvVER to aKt as proQurator ceases: (a) as soon as he has fulfilled his office; (b) if with a sufficient reason he resigns; (c) if the principal or appointer revokes his mandate; but he must do this in due time, that is, while the affair still remains untouched (re integra); this revocation must be brought to the notice of the proQurator before the latter komple.t.ez the transaction; one of the chief exceptions to these rulez is wHEN there is queztion 'oVf a proQuration to kontrakt a marriage.t., in wHITh case etc.etc!
